Cabinet approves new bill to ban unregulated deposits, tweak chit funds Act
The union cabinet, an official release said, has given approval to introduce the banning of Unregulated Deposit Schemes Bill, 2018, in parliament.
The government on Tuesday said it will come out with a new bill in Parliament to ban unregulated deposit schemes, with a view to curbing defrauding of gullible investors.
The cabinet, chaired by Prime Minister Narendra Modi, also decided to make changes in the Chit Funds Act to enable greater financial access of people to other financial products.
The union cabinet, an official release said, has given approval to introduce the banning of Unregulated Deposit Schemes Bill, 2018, in parliament.
“The bill is aimed at tackling the menace of illicit deposit taking activities in the country.
“Companies/ institutions running such schemes exploit existing regulatory gaps and lack of strict administrative measures to dupe poor and gullible people of their hard-earned savings,” it said.
Regarding changes in the Chit Funds Act, the release said the government aims to facilitate orderly growth of the segment and remove bottlenecks being faced by the industry.
The amendment will enable “greater financial access of people to other financial products”, the release said.
अनरेग्युलेटेड डिपॉजिट स्कीम बिल को मंजूरी, बिटक्वॉइन जैसी क्रिप्टो करंसी पर लगेगी रोक:-
नई दिल्ली. कैबिनेट ने अनरेग्युलेटेड डिपॉजिट स्कीम बिल और चिटफंड (संशोधन) बिल को मंजूरी दे दी है। इनका मकसद पोंजी स्कीम्स और बिटकॉइन जैसी वर्चुअल करंसी पर रोक लगाना है। बिल को कैबिनेट की मंजूरी मिलने के बाद संसद में पेश किया जाएगा। जहां से पास होने के बाद यह कानून की शक्ल ले लेगा।
वर्चुअल करंसी में ट्रेडिंग को लेकर रेग्युलेशन नहीं
- इस बिल के कानून की शक्ल लेने पर ऐसी डिपॉजिट स्कीम्स, जिसके लिए सरकार ने रेग्युलेशन नहीं जारी किया है, गैरकानूनी हो जाएंगे।
- अभी वर्चुअल करंसी में ट्रेडिंग पर कोई रेग्युलेशन नहीं है। हालांकि, देश में इसकी ट्रेडिंग बैन नहीं है।
- उधर, देश में बिटकॉइन जैसी वर्चुअल करंसी में बढ़ रही ट्रेडिंग को लेकर आरबीआई लोगों को बार-बार आगाह कर रहा है।
- उसका कहना है कि इसके लिए कोई रेग्युलेशन नहीं है और किसी तरह के नुकसान को लेकर इन्वेस्टर्स खुद जिम्मेदार होंगे।
चिटफंड कानून में होगा बदलाव
- चिटफंड (संशोधन) बिल 2018 को भी मंजूरी दे दी है, जिससे पोंजी स्कीम्स पर रोक लग सकेगी।
- इस बिल के जरिए चिटफंड अधिनियम 2018 में बदलाव किया जाएगा। इससे चिटफंड कंपनियां नए फाइनेंशियल प्रोडक्ट बाजार में उतार सकेंगी।
- संशोधन के जरिए चिटफंड कंपनियों की चलाने के तौर-तरीकों में भी बदलाव किया जाएगा। इसका मकसद देश में गैरकानूनी तरीके से चल रहीं स्कीम्स पर रोक लगाना है। बिल में इस तरह की डिपॉजिट स्कीम चलाने वालों के खिलाफ सख्त सजा तय की गई है।
बिल की अहम बातें.....
- एक ऑनलाइन डाटाबेस बनेगा जिसमें अनरेग्युलेटेड डिपॉजिट स्कीमस की पूरी जानकारी उपलब्ध होगी।
- कोई भी संस्था डायरेक्ट या इनडायरेक्ट, विज्ञापन के जरिए या फिर लोगो से आग्रह कर अनरेग्युलेटेड डिपॉजिट स्कीम नहीं चलाएगी।
- नियम तोड़ने पर कम से कम 3 और ज्यादा से ज्यादा 10 साल तक के लिए जेल की सजा हो सकती है। साथ ही जितना फंड स्कीम के तहत जुटाया गया है, उसका दो गुना तक जुर्माना भरना होगा।
- अगर कोई संस्था रेग्युलेटेड डिपॉजिट स्कीम में मियाद पूरी होने पर धोखा कर पैसा वापस नहीं चुकाए तो उसके लिए 7 साल तक की सजा का प्रावधान है।
- जमाकर्ताओं के पैसे जुटाने के लिए संपत्ति जब्त करने का भी प्रावधान है। इसके साथ गलत तरीके से कमाए गए मुनाफे को प्रभावित लोगों के बीच बांटने की भी व्यवस्था होगी।
- संपत्ति जब्त करने और प्रभावित लोगों को मदद पहुंचाने का काम तय समय सीमा के अंदर होगा।

- इस बिल के जरिए चिटफंड अधिनियम 2018 में बदलाव किया जाएगा। इससे चिटफंड कंपनियां नए फाइनेंशियल प्रोडक्ट बाजार में उतार सकेंगी।
- संशोधन के जरिए चिटफंड कंपनियों की चलाने के तौर-तरीकों में भी बदलाव किया जाएगा। इसका मकसद देश में गैरकानूनी तरीके से चल रहीं स्कीम्स पर रोक लगाना है। बिल में इस तरह की डिपॉजिट स्कीम चलाने वालों के खिलाफ सख्त सजा तय की गई है।
